1. Applicability of the Terms and Conditions

These General Terms and Conditions (GTC) apply to all contracts concluded with Döllmann Design + Architektur ZT GmbH (Little Suites Apartments Vienna). They may be supplemented by terms and conditions negotiated on a case-by-case basis. These are clearly displayed in the apartments and can also be found on our website.

2. Conclusion of the rental agreement for a holiday apartment

The current price applies, which may vary depending on the season and occupancy. In all other respects, services and rates are subject to change. The accommodation contract may be concluded in writing, verbally, by telephone or by conclusive conduct. The conclusion of the accommodation contract obliges both contracting parties to fulfil the contract, regardless of the duration for which the contract is concluded. For overnight stays in our apartments, the accommodation contract is concluded as soon as the room has been booked.

The customer undertakes to check the booking confirmation received immediately for accuracy and to notify Little Suites Apartments of any inaccuracies or discrepancies. Any notification of inaccuracies or discrepancies received more than three days after receipt of the booking confirmation cannot be taken into account. In particular, inaccuracies or discrepancies reported late do not entitle the customer to withdraw from the contract.

3. Bookings

Rooms reserved and confirmed by Little Suites Apartments are made available from 3.00 pm on the day of arrival and must be vacated by 10.00 am on the day of departure.

4. Price changes

Agreed prices may be amended by Little Suites Apartments in accordance with the current price lists after the contract has been concluded, provided that the period between the conclusion of the contract and the provision of the individual services exceeds four months.

5. Terms of payment

Unless other terms of payment have been expressly agreed, invoices are payable in full in advance without deduction. This can be done by bank transfer. Any delay in payment due to error messages from the bank entitles Little Suites Apartments to cancel the booking.

Personal data entered in the registration form, such as name, address and, where applicable, credit card number, sort code and account number, is encrypted using SSL technology. This involves converting the entered data into a code so that it cannot be read by unauthorised persons whilst being transmitted over the internet.

6. Cancellations, cancellation fees

In the event of cancellations of bookings by the guest or failure to make use of the services offered by Little Suites Apartments, the contractual services ordered and reserved but not taken up by the guest, yet provided by Little Suites Apartments, will be charged to the guest at the following flat rates:

Cancellation up to 14 days prior to the provision of the relevant services: Free cancellation

Cancellations from the 13th day prior to the provision of the relevant services: 100% of the ordered services will be charged

Non-utilisation due to no-show without prior cancellation of the relevant services: 100% of the ordered services will be charged.

The above cancellation fees shall also apply if the services booked have been cancelled only in part by the guest, in which case the stated flat rates shall relate to the portion of the services that has been cancelled, or if the guest fails to make use of the services booked without expressly cancelling them.

7. Liability

The liability of Little Suites Apartments is governed by Section 970 of the General Civil Code (AGBG). Liability on any other grounds is excluded, unless the damage was caused by Little Suites Apartments, its legal representatives or vicarious agents through wilful misconduct or gross negligence.

8. Withdrawal by Little Suites Apartments

Little Suites Apartments may not unilaterally withdraw from the concluded contract. Exceptions are: force majeure or strike.

Force majeure includes damage to essential utilities such as heating and sanitary facilities, as well as damage to the hotel building, which was not caused by the operators of the apartments. In the event of an emergency, Little Suites Apartments may withdraw from concluded accommodation contracts without being required to reimburse any costs.

9. Miscellaneous Provisions

9.1. Theft or robbery by uninvolved third parties or outsiders: Once the door code or key has been handed over, Little Suites Apartments accepts no liability for theft or vandalism if the external door has not been properly closed by guests. Guests are required to ensure that the external doors are kept closed upon leaving the apartment. In the event of a negligent or deliberate breach of the regulations regarding the locking of external doors, the guest may be held liable for any damage incurred by Little Suites Apartments. Any damage caused to the furnishings or fittings of the apartments by the guest or tenant must be reported by the guest or tenant to the owner of Little Suites Apartments. The costs of repair shall be borne by the guest or tenant. This excludes wear and tear or general repairs to furnishings or fittings for which Little Suites Apartments is responsible.

9.2. The codes or keys issued by Little Suites Apartments must not be handed over to unauthorised third parties or strangers.

9.3. Items or belongings belonging to the guest and left in vehicles in the car parks are not covered by the general terms and conditions of Little Suites Apartments, and the operator accepts no liability for them. Little Suites Apartments also accepts no liability for any personal belongings or items left by the guest outside the lockable guest rooms, i.e. in the garden, courtyard, on the terrace or in the car.

9.4. Little Suites Apartments accepts no liability for damage caused by falling branches or trees to cars parked in the car parks opposite or adjacent to the apartments.

9.5. Stoves provided in the apartment may only be used in consultation with the operator. Use is at the guest’s own risk following instruction. The guest is liable for any damage caused by smoke, soot or fire to the furnishings and the building.

The Terms and Conditions, as well as the design and furnishings (via photos) of the apartments, are made available to every guest on our website.

Austrian law applies to these terms and conditions and to all legal relationships between Little Suites Apartments and the guest.

In addition to the provisions of German law, only these Terms and Conditions of the operator of Little Suites Apartments shall apply in all cases.

Severability clause

Should any provision of this contract be or become invalid, or should the contract contain a gap requiring interpretation, this shall not affect the validity of the remaining provisions. The invalid provision or gap shall be replaced by a provision that comes closest to the economic purpose of the agreement and which the parties would have agreed upon had they been aware of the invalidity of the provision.

The place of jurisdiction for Döllmann Design + Architektur ZT GmbH is the Vienna Local Court.
